Morris Nichols Files Pro Bono Amicus Brief in Delaware Consumer Protection Case

Acting as pro bono counsel, a Morris Nichols team filed an amicus brief with the Delaware Supreme Court on behalf of the Community Legal Aid Society, Inc. (CLASI) and the Delaware Manufactured Home Owners Association (DMHOA) in a case involving the enforcement of the Delaware Consumer Fraud Act.

The case, Blue Beach Bungalows DE, LLC v. Delaware Department of Justice Consumer Protection Unit, asks the Delaware Supreme Court to rule on the constitutionality of the Consumer Protection Unit’s administrative enforcement process under the Delaware Constitution.  This process is critical to providing a streamlined procedure to protect the rights of low-income individuals.

Morris Nichols intellectual property litigators Jack Blumenfeld, Karen Jacobs, and Ben Yenerall wrote the brief in support of the Delaware Department of Justice.
