There have been a series of recent articles in The Wall Street Journal, the Washington Post and other national news outlets discussing Delaware’s leadership in enacting legislation designed to provide fiduciaries with access to the online accounts and digital content belonging to individuals who have died or become incapacitated, access which has not been easy to achieve for fiduciaries who often face either confusion on the part of, or lack of cooperation from, Internet providers.  The Delaware Law Weekly article provides an overview of the law, the Delaware legislative process and the role of the ULC Delaware Commissioners, including Mike Houghton, in the drafting and passage of the law in Delaware.
