Morris Nichols Again Among Most-Active US Law Firms in Lex Machina Patent Litigation Report 2023
Morris Nichols is again among the most-active US law firms in Lex Machina’s 2023 Patent Litigation Report released today.
The annual report analyzes trends and insights from patent litigation across the US over a three-year period.
The report recognizes Morris Nichols as one of the most-active law firms by district court cases filed, and the only firm to appear among the top ten most active law firms for both plaintiff (#8) and defense side work (#3). Highlighting the firm’s substantial case volume, the report also notes, “as local counsel in the District of Delaware, the firm generally did not represent high-volume plaintiffs, though it defended against them in 42% of cases representing defendants.”
Morris Nichols’ plaintiff-side work largely comes from branded pharmaceutical companies which retain it as local counsel on abbreviated new drug application (ANDA) cases, accounting for approximately 20% of overall patent filings in Delaware.
As lead or Delaware counsel, Morris Nichols has represented branded pharmaceutical companies in more than half of the ANDA litigation filed in the District of Delaware in the past three years. This provides us with unparalleled insight into the Delaware court and judges, various litigation scenarios, and recurring generic parties and their counsel.
