Complete Win for HID Global in Trade Secrets and Patent Trial
Morris Nichols, together with co-counsel Morgan, Lewis & Bockius, represented HID Global, an American manufacturer of secure identity products in a case against three former employees and their new company for theft and misappropriation of trade secrets, breach of contract, breach of fiduciary duty, and patent infringement case.
On January 23, 2024, a Delaware jury found in favor of HID Global, awarding the full $38.9 million in damages that HID sought on unjust enrichment for trade secret misappropriation, plus a finding that the misappropriation was willful and malicious. The jury also awarded $6.1 million for lost profits for patent infringement, plus a finding that the patent infringement was willful.
A second trial concerning breach of contract and breach of fiduciary duty claims was scheduled for March 2024. Shortly before the March bench trial, the parties entered into a consent judgment and permanent injunction, concluding the litigation as a complete win for HID Global.
